Terms of Service

These Terms of Service ("Terms") govern your use of the Perkora Hometown Savings Pass, the Perkora websites, and related services (together, the "Services") provided by Crescent Consumer Brands LLC, a Louisiana limited liability company doing business as Perkora ("Perkora," "we," "us," or "our"). By getting a Savings Pass, creating an account, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Participating automotive stores ("Store Operators") and local businesses that provide offers ("Merchants") are also bound by their separate Perkora participation agreements. If those agreements conflict with these Terms, the participation agreement controls for that business.
1. The Savings Pass
- A Savings Pass is provided free by a participating Store Operator, typically with a qualifying service such as an oil change. Store Operators decide when and to whom a pass is offered.
- Your pass is valid for the period shown on your pass, generally six months from the date it is issued. Offers cannot be redeemed after your pass expires.
- Your pass is personal to you. It is not transferable, has no cash value, and may not be sold, traded, or exchanged for cash or credit.
- The total "pass value" shown is an estimate based on the offers available when it is calculated. Actual savings depend on which offers you use and what you purchase.
2. Offers
- Offers are provided by independent Merchants, not by Perkora or the Store Operator. Each Merchant is solely responsible for its products, services, pricing, staff, and premises, and for honoring its offer.
- Unless an offer states otherwise, each offer may be redeemed once per pass. Offers are subject to the Merchant's stated restrictions, availability, and business hours, and may not be combined with other discounts unless the Merchant allows it.
- To redeem an in-store offer, show your pass to the Merchant at the time of purchase and redeem it in front of their staff. For percent-off offers, the savings recorded are calculated from the purchase amount you enter.
- Offers and participating Merchants can change. A Merchant's offer that has already been issued to your pass will generally remain available for the rest of your pass period, but Perkora does not guarantee that any particular Merchant or offer will remain available.
3. Your account
You sign in using a secure link sent to your email address. You agree to provide accurate information, to keep access to your email account secure, and to let us know if you believe someone else has accessed your pass. You are responsible for activity on your pass.
4. Acceptable use
You agree not to:
- create multiple accounts or use false information to obtain additional passes;
- redeem an offer without making a qualifying purchase, or redeem on behalf of someone else;
- share, copy, sell, or publish your pass or its offers;
- interfere with, scrape, reverse engineer, or attempt to gain unauthorized access to the Services; or
- use the Services for any unlawful or fraudulent purpose.
5. Pausing or ending a pass
Perkora or the Store Operator that issued your pass may pause, limit, or cancel a pass, or refuse a redemption, if we reasonably believe it is being misused, was obtained improperly, or violates these Terms. We may also modify or discontinue the Services, in whole or in part.
6. Independent businesses
Store Operators and Merchants are independent businesses. They are not employees, agents, or partners of Perkora, and Perkora is not responsible for their acts, omissions, products, or services. Any dispute about a product or service you purchase is between you and that business.
7. Intellectual property
The Services, including the Perkora name, logo, software, and content, are owned by Perkora or its licensors and are protected by law. Store Operator and Merchant names and logos belong to their respective owners. You may use the Services only for your personal, non-commercial use as described in these Terms.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, PERKORA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY OFFER WILL BE AVAILABLE OR HONORED.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PERKORA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM A STORE OPERATOR'S OR MERCHANT'S PRODUCTS, SERVICES, OR CONDUCT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
10. Governing law
These Terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-law principles, except where the law of your place of residence requires otherwise.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the effective date above, and if the changes are significant we will provide additional notice. Continuing to use the Services after an update means you accept the updated Terms.
